DMCA

Bedfordshire Prepared (“we,” “our,” or “us”) respects the intellectual property rights of others and expects our users and contributors to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (“DMCA”).

This page describes the information that should be present in these notices. It is designed to make submitting notices of alleged infringement to us as straightforward as possible while reducing the number of notices we receive that are fraudulent or difficult to understand or verify.

1. Reporting Copyright Infringement (DMCA Takedown Notice)

If you are a copyright owner or an agent thereof and believe that any content on the Bedfordshire Prepared website infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our designated Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Providing specific URLs is the best way to help us locate content quickly.
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Designated Copyright Agent

Please send all DMCA notifications containing the above information to our designated Copyright Agent:

Email: [Insert designated DMCA email address, e.g., dmca@bedfordshireprepared.org.uk]

3. Counter-Notification

If you believe that material you posted on the site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification pursuant to sections 512(g)(2) and (3) of the DMCA. It must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., for any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. The original complainant will then have 10 business days to notify us that they have filed a court action relating to the material. If we do not receive such notification, we may restore the material at our discretion.

4. Repeat Infringers

It is our policy, in appropriate circumstances and at our discretion, to disable or terminate the accounts of users who are repeat infringers of intellectual property rights.
